This Privacy Policy describes how Favr.town, Inc., and its affiliates ("we", "us", or "Favr.town"), process personal information that we collect through the Favr.town Platform ("Favr.town", "Platform", or "Services"). DEFINITIONS Undefined terms in this Privacy Policy have the same definition as in our Terms of Service ("Terms"). APPLICATION OF THIS POLICY This policy applies to all personal information that we collect, use, disclose and store when you access our Services or apply for a job with Favr.town. This policy does not apply to the Content uploaded by Merchants, including business information and business contact, nor does it apply to aggregated and/or anonymized information. In some situations, we may rely on exemptions or other permitted conduct under applicable laws, including to collect, use, disclose or store personal information for purposes not described in this policy. PERSONAL INFORMATION WE COLLECT We carefully analyze what types of information we need to provide our services, and we try to limit the information to what we really need. Where possible, we delete or anonymize this information when we no longer need it. 1. Information Needed to Use the Favr.town Platform We collect personal information about you when you use the Favr.town Platform. Without it, we may not be able to provide you with all Services requested. This information includes: contact information, account, profile information, such as your first name, last name, phone number, postal address, email address, date of birth, and profile photo, some of which will depend on the features you use. 2. Information Automatically Collected by Using the Favr.town Platform When you use the Favr.town Platform, we automatically collect personal information. This information may include: Usage information, such as the pages or content you view, Merchants you follow ("Favr"), rewards you have earned and redeemed, communications with Merchants, and other actions on the Favr.town Platform. Log data and device information, such as details about how you've used the Favr.town Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you've viewed or engaged with before or after using the Favr.town Platform. We may collect this information even if you haven't created a Favr.town account or logged in. Favr.town doesn't use Cookies directly. However, parts of Favr.town may integrate with, or link to third-party services, not owned or controlled by Favr.town, such as Facebook, Google, or Stripe. Use of these services is subject to the cookie policy of those providers. 3. Advertising and Conversion Tracking We use Google Ads to deliver targeted advertising to our users. To understand how effective our ads are, we use conversion tracking tags provided by Google Ads. These tags collect data about your activity on our website after you click on a Google Ad. This data may include the pages you visit and actions you take on our site. We use this information to improve the performance of our advertising campaigns and to deliver ads that are more relevant to your interests. HOW WE USE INFORMATION WE COLLECT Provide, Improve, and Develop the Favr.town Services Platform. We use personal information to: - enable you to access the Favr.town Platform and earn and redeem rewards, - enable you to communicate with other users, perform analytics, debug, and conduct research, provide customer service, - send you messages, updates, security alerts, and account notifications, - facilitate your requests or for any other purpose you authorize, - personalize and customize your experience based on your interactions with the Services, your reward history, your profile information and preferences, and other Content you submit. Create and Maintain a Trusted and Safer Environment. We use personal information to: - detect and prevent fraud, spam, abuse, security and safety incidents, and other harmful activity, - conduct security investigations and risk assessments, - verify or authenticate information provided by you, - resolve disputes with our users, - enforce our agreements with third parties, - comply with law, respond to legal requests, prevent harm, and protect our rights, protect the health and well-being of our users and members of the public, - enforce our Terms and other policies. Provide, Personalize, Measure, and Improve our Advertising and Marketing. We may use personal information to: - send you promotional messages, marketing, advertising, and other information that might be of interest to you, - personalize, measure, and improve our advertising, - administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Favr.town or its third-party partners, and - invite you to events and relevant opportunities. SHARING & DISCLOSURE Sharing With Your Consent or at Your Direction You control which Merchants you follow ("Favr"), which Patrons you connect with, and which features you use. By choosing to interact with a Merchant, connect with a Patron, or engage with specific features, you are consenting to share your personal information with the relevant parties. Sharing Between Users Certain features require certain information to be shared, such as: Between Patrons and Merchants When you interact with a Merchant, your Favr tracking with that Merchant begins automatically. The following information is shared to identify you and manage rewards: - Personal Information: Username, profile photo, full name, address, birthday, zip code, email, and phone number. - Preferences: Your product preferences with that Merchant and reward meter status. - Activity: Communication history, reward log, and interactions with the Merchant to ensure rewards are tracked, honored, and customer service is provided. If you opt for mail-in rewards, or rewards tied to birthdays or special occasions, your address and relevant dates will be shared with the Merchants you follow ("Favr") to deliver those rewards. When you submit suggestions or comments, that content, your username, and profile photo will be visible to the public. Between Patrons and Patrons - Friends Profile: Your Friends profile information is visible to other Patrons. - Friends Compatibility (FC) Score: Both you and the other Patron can view your FC score. - Romance Profile: This profile is visible to potential matches. - Compatibility Quotient (CQ) Score: Both you and a potential match can see your CQ score. - Attribute Match-Up Results: You and your contact can access your attribute comparison. - Poll Results: When you answer a poll, you can view other Patrons who selected the same answer, and they can see that you did too. - Maze Results: When you complete a maze, you can view other Patrons who also participated and see your comparisons with them, and they can do the same with you. Merchant Information When you register as a Merchant and publish your Merchant profile page, that Content and the number of Patrons who follow ("Favr") you are public. Your suggestion board and its content are publicly visible. Information you share publicly on the Favr.town Platform may be indexed through third-party search engines. We may display parts of your public profile and other Content you make available to the public on third-party sites, platforms, and apps. Complying with Law, Responding to Legal Requests, Preventing Harm and Protecting our Rights We may disclose your information to courts, law enforcement, governmental or public authorities, tax authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary: (i) to comply with our legal obligations, (ii) to comply with a valid legal request or to respond to claims asserted against Favr.town, (iii) to respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity, or to respond to or address any other activity that may expose us, you, or any other of our users to legal or regulatory liability, (iv) to enforce and administer our agreements with Users, or (v) to protect the rights, property or personal safety of Favr.town, its employees, its users, or members of the public. Service Providers We share personal information with affiliated and unaffiliated service providers to help us run our business, including service providers that help us: (i) perform product development, maintenance and debugging, (ii) allow the provision of the Favr.town Services through third-party platforms and software tools (e.g. through the integration with our APIs), (iii) provide customer service, advertising, or payments services, or (iv) facilitate non-profit and charitable activities consistent with Favr.town's mission. These providers are contractually bound to protect your personal information and have access to your personal information to perform these tasks. Business Transfers If Favr.town undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy. Third-Party Partners & Integrations Parts of Favr.town may link to third-party services, not owned, or controlled by Favr.town, such as Google Search/Maps/Earth. Use of these services is subject to the privacy policies of those providers, such as Google Search/Maps/Earth Additional Terms of Use, Google Privacy Policy (see here for more information on how Google uses information). Favr.town does not own or control these third parties and when you interact with them you are providing your information to them. YOUR RIGHTS OVER YOUR INFORMATION We believe you should be able to access and control your personal information no matter where you live. In Favr.town, all your personal information and your activity log are displayed to you in-app. You can access and modify your personal information at any time or delete your account altogether. For information you shared with your Favr'd Merchants through the Platform and their handling of your information outside of the Platform, please directly contact the Merchant you interacted with. When we do so, we will post the most current version of the Privacy Policy on the Favr.town Platform, and if a revision to the Privacy Policy is material, Favr.town will notify you of the new policy (for example, by email or a notification on the Services). Changes to the Privacy Policy will not apply retroactively. If you do not agree to the modified policy, you should discontinue your use of the Services immediately as provided in the Terms. If you do not terminate, your continued access to or use of the Favr.town Platform will constitute acceptance of the revised Privacy Policy.
